We wish you to have an enjoyable shopping experience while visiting our on-line showroom.  However, we do need to disclose some T&Cs so that you understand your rights when making a purchase from us.  Feel free to contact us should you have any queries at all!

Introduction

In these terms and conditions, David Keefe Jewellers includes any reference to “we” “us” and “our”. Your access to and use of all information on our website including purchase of our products and services is provided subject to these following terms and conditions. We may amend these terms and conditions at any time.  Your use of the website following any amendments will represent your agreement to be bound by the amended terms and conditions as amended.

Prices

All prices are listed in New Zealand Dollars (NZD) and are inclusive of GST. We endeavour to ensure that our prices are current but we do reserve the right to amend our prices at any time.

Product Descriptions and Images

We strive to ensure that our products are described as accurately as possible.  However, errors and accidental misdescriptions may occur from time to time, and we do not accept liability for any such error or misdescription.  Images have been provided for illustrative purposes and we do not guarantee that images will reproduce in true colour nor that any given image will reflect or portray the full design or options relating to that item.

Product Orders

Packaging and postage is free to customers residing in New Zealand.  Additional charges may apply at time of purchase for customers residing outside of New Zealand.

Our products are for sale to adults over the age of 18 years. By proceeding to purchase through our website, you acknowledge that you are over 18 years of age.

When you place an order, we will need you to provide your name, address for delivery, your email address, telephone contact and credit card details. We undertake to take due care with this information; however in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.

Tax free Purchases

Conditions apply for tax free purchases. The tax free price for the item must be a minimum of $1,000 to qualify for tax free. The item must be collected from Auckland Airport immediately prior to an international flight and in accordance with NZ Custom's requirements. Further information is available upon request.

Delivery times and Receipt of Parcel

In some instances, a certain item of jewellery may need to be specially created or adjusted to your specific finger, wrist or neck size, or for some other reason to be specially made. In this case there may be a delay with delivery. We will make contact and advise you of any such delay at the time of order.

We usually only carry one of an item in stock at any time, and, occasionally, the item may be out of stock at the time an order is placed.  In this event, there be a delay with an item that you have ordered, and we will notify you at the time of order to explain the delay and the time required.  In this event, you will have the opportunity to cancel the order and obtain a full refund.

We will advise you as soon as possible if there is a delay on the delivery of any item you have ordered. For delivery within New Zealand, we expect your order to be delivered within 2 to 3 working days. Rural deliveries may take longer. 

Once your order has been shipped, we will email you with a tracking ID. Simply follow the link in the email to track the delivery of your parcel.

All deliveries will require a signature on delivery. If there is no one to sign for the package when the courier driver calls, the courier will leave a card to call with details for redelivery. It is advisable to provide an address where there will be someone during business hours.

Order Cancellation Due to Error

Where a product has been listed at an incorrect price, or with an incorrect description or image, we have the right to cancel the transaction. If your credit card has been charged, we will immediately refund your credit card for the amount debited.

Returns

Items purchased through our website may be returned for a refund or replacement within 14 days of receiving the goods. Excluded are any items that have been sized or adjusted, that have been worn or marked, or that were specially ordered.

Once you have notified us through our website or by email that you wish to return an item, and you have provided valid proof of purchase, you may return the item to our LynnMall showroom at the address below.

We shall refund an item within 14 days of purchase so long as the item is returned undamaged, unused and with proof of purchase.  You agree to accept the cost of packing, courier and insurance charges for any products that are returned to us.  Return of any products is at your cost and risk and we do recommend that you ensure you have insurance cover on the item prior to return.

Subject always to the provisions of the Consumer Guarantees Act, we shall have no liability to refund the original purchase price for any item if the item has been worn or marked or damaged. Returned items must be in the original condition, unworn, and with the original certificates, warranty cards, instruction booklets, packaging and boxes. Please wrap the goods securely, it is your responsibility to return the goods in the same condition as they were delivered. 

A “signature required” parcel must be used and we recommend that you keep a copy of your courier parcel tracking number until we have acknowledged receipt.

Intellectual Property Rights

The copyright to all content on this website including applets, graphics, images, layouts and text belongs to us or we have a license to use those materials.

All trademarks, brands and logos which are used on this website are either owned by us or we have a license to use them. Your access to our website does not give you any right or license you to use those marks.

Disclaimers

Whilst we have taken all due care in providing the information on our website, we do not provide any warranty either express or implied including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose.  To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded.

We also take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.

Limitation of Liability

To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the goods and/or services again or payment of the costs of having those goods and/or services supplied again. We accept no liability for any loss whatsoever including consequential loss suffered by you arising from any product that we have supplied.

New Zealand Law

These terms and conditions are to be governed by and construed in accordance with the laws of New Zealand and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in New Zealand and you agree to submit to the jurisdiction of those Courts.

If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

Privacy

We undertake to take all due care with any information which you may provide to us when accessing our website. However we do not warrant and cannot ensure the security of any information which you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner. Our compliance with privacy legislation is set out in our separate Privacy Policy which may be accessed from our home page.
